General Terms of Use Agreement

 

Cebu Heart is a free dating service for single people to meet each other online. This service provided by Cebu Heart is free of charge. No credit cards. This agreement is made between you and us (Cebu Heart). Please read this agreement carefully before you register for the service. The Terms of Use are subject to change by us at any time, effective upon posting on our site, and your use of the service after such posting will constitute acceptance by you of such changes.

By registering with Cebu Heart, you become a user of the service (a "user"). You agree to be bound by the Terms of Use, both as long as you continue to be a user and after your registration is terminated.

 

Eligibility

 

You must be eighteen or over to register as a user of Cebu Heart. By becoming a user, you represent and warrant that you are eighteen years old above. Your free membership for our service is for your sole personal use. You may not authorize others to use your membership. You may not assign or otherwise transfer your account to any other person or entity.

 

Term

 

This Agreement will remain in full force and effect while you use the service and/or are a user. You may terminate your free account at any time, for any reason, by e-mailing us a notice of termination. Cebu Heart may terminate your account for any reason, effective with or without notice. Even after your account is terminated, this Agreement will remain in effect.

 

Use of the service/content posted on the site

  • One person is allowed only one profile on Cebu Heart.
  • Impersonating any person or entity is forbidden.
  • The use of our services to certain countries is limited. If your country is not listed in our registration form, you may not use the service.
  • You understand and agree that Cebu Heart may review and reject or delete any content, messages, photos, or profiles (collectively, "content") that, in the sole judgment of Cebu Heart, violate this Agreement, might be offensive or illegal, or might violate the rights, harm, or threaten the safety of users. Any signs of possible future spam/scam action may cause profile rejection.
  • You agree that you are providing true information (e.g., gender or location) about yourself. You acknowledge that if your registration data is untrue in any respect, we have the right to terminate this Agreement.
  • To join the Cebu Heart community, you should set a real country and city you live in. Otherwise, your profile will be rejected from our Web site.
  • We do not accept profiles registered with proxy.
  • No explicit sexual description and nude pictures.
  • No fake, model, and cartoon photos. Photos with other sites' logos will be deleted.
  • You agree to use our service only for dating and meeting people. Games or harassment behavior are not permitted.
  • No couples, shemales, transgendered people, naturists, and cross-dressers.
  • In case of a questionable issue, the Web site administrator may ask for additional information.
  • Cebu Heart is for noncommercial use. Companies, organizations, and marriage agencies may not be users of this site.
  • You are solely responsible for the content that you publish or display (hereinafter, "post") on the service, or transmit to other users.
  • Please do not criticize the site actions here. You may send us your suggestions and feedback by e-mail from the Contact Us page.
  • You must use the service in a manner consistent with any and all applicable laws and regulations.
  • You may not engage in advertising to or solicitation of other users to buy or sell any products or services through this Web site. You may not transmit any chain letters or junk e-mail to other users. Although Cebu Heart cannot monitor the conduct of its users off the Web site, it is also a violation of these rules to use any information obtained from the service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any user without their prior explicit consent. In order to protect our users from such advertising or solicitation, we may terminate an offending user's membership.
  • Cebu Heart has a right to use the links to its users' profiles and photos in company advertising. Those links should be placed only on Cebu Heart partners' sites.
  • Profiles, postings, and blogs are publicly viewable. Cebu Heart pages may be indexed by search engines. We are not responsible for search engines' results.  

 

Use of the chat

 

Cebu Heart chat is a free-of-charge service helping users communicate and get to know one another better. The site administrator may view the chat from time to time. Please read our chat rules before using it.

  • No offensive, insulting, or explicit language, please. Offensive references to sex, gender, sexual orientation, or ethnicity are forbidden.
  • Do not threaten or abuse other users. If anyone threatens or abuses you, please report him or her.

 

If you violate our rules, you will be banned from the chat with or without notice, and your account may be terminated.

 

Copyright policy

 

You may not post, reproduce, or distribute in any way any copyrighted material, trademarks, or other proprietary information without obtaining prior written consent from the owner of such proprietary rights.

 

Privacy

 

Use of the Web site and/or the service is also governed by our Privacy Policy.

 

Disclaimers

 

Cebu Heart is not responsible for any incorrect or inaccurate content posted on the Web site or in connection with the service, whether caused by users of the Web site or by other people. Cebu Heart is not responsible for the online or offline conduct of any user of the Web site. Under no circumstances will Cebu Heart be responsible for any loss or damage, including personal injury or death, resulting from anyone's use of the Web site or the service, any content posted on the Web site or transmitted to users, or any interactions between users of the Web site, whether online or offline.

 

The Web site and the service are provided AS IS, and Cebu Heart expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Cebu Heart cannot guarantee and does not promise any specific results from use of the Web site and/or the service.

 

User disputes

 

You are solely responsible for your interactions with other users of Cebu Heart. We reserve the right, but have no obligation, to monitor disputes between you and other users.

 

Complaints

 

To resolve a complaint regarding the service, you should first contact our customer service department through our Contact page.

 

Limitation on liability

 

Except in jurisdictions where any such provisions are restricted, Cebu Heart will in no event be liable to you or any third person for any consequential, exemplary, incidental, indirect, special, or punitive damages, including lost profits arising from your use of the Web site or the service, even if Cebu Heart has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Cebu Heart's liability to you for any cause whatsoever, regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Cebu Heart for the service during the term of membership.

 

Other

 

This Agreement, accepted upon use of the Web site and further affirmed by becoming a user of the service, contains the entire agreement between you and Cebu Heart regarding the use of the Web site and/or the service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
